Desmond’s principal area of practice is medical and healthcare law. He has developed extensive experience and knowledge in advising and representing both patients and healthcare professionals in a wide range of medico-legal disputes, disciplinary proceedings, and healthcare-related matters.

Over the years, Desmond has appeared at all levels of the Malaysian Courts. He was involved in several significant and landmark medical negligence cases, including amongst others Siow Ching Yee v Columbia Asia Sdn Bhd [2024] 3 MLJ 66, in which the Federal Court clarified and affirmed the non-delegable duty of care owed by private hospitals in Malaysia.

Having had personal exposure to the challenges arising from adverse medical outcomes, Desmond appreciates the profound emotional, physical, and financial consequences that medical disputes can have on patients and their families. This personal experience has reinforced his commitment to approaching every matter with diligence, empathy, and sensitivity.

Importantly, Desmond brings a balanced perspective to his practice, having acted for both patients and healthcare practitioners. He understands the concerns, expectations, and pressures faced by patients seeking answers and accountability, as well as the professional and personal challenges encountered by medical practitioners when allegations are made against them. This dual perspective enables him to provide practical, measured, and strategic advice while remaining sensitive to the interests and circumstances of all parties involved.

Desmond has also undertaken some work on occupiers’ liability and other personal injury cases and product liability cases.
